Evergreen (1934) is a British film. This is my current understanding of copyright of British films in the US from
this post and
this one as applied to British-registered films released before 1956. If it was PD in the US before GATT (1996) it's PD now. British copyright protection for a British-registered film from that time was 50 years. I don't know if
Evergreen's copyright was registered in the US. If it was, that registration wasn't renewed. Its US copyright protection would then have expired in 1962, well before GATT. If it was never registered here then it would be PD here, since its British copyright expired in 1984, also before GATT.
So I'd say it's PD.
